Before you can file a trademark application, you must conduct an availability search for the name and/or logo you wish to use. If the agent’s search report is positive, you will then be able to obtain our trademark registration filing kit.
This search must be performed by a trademark agent, who is qualified to determine whether or not it is possible to file an application for registration and to advise you in this regard. The report will determine, among other things, whether the name you wish to use is available, whether it is not confusing with other trade-marks and whether it is registrable in the desired territory.

In Canada, a work is protected by copyright as long as it is original and fixed on a medium. The expression of ideas is protected, but ideasthemselves are not. This right grants the author an exclusive right to produce or reproduce all or significant parts of his work. In other words, no one may copy someone else’s work without the author’s permission. In Canada, copyright is protected automatically.
Copyright registration is strongly recommended to protect your creations and has several advantages. Following the steps, you will obtain a certificate of registration. This certificate will serve as proof that the copyright on the work exists in your favor and that you are indeed the owner of the work, in the event of a dispute, for example.

Even if your copyright is not registered, you may use this symbol followed by the name of the copyright owner and the year your work was first published.


Registration of a trademark
Registration of a trademark with the Canadian Intellectual Property Office (CIPO), the United States Patents and Trademarks Office (USPTO) or the European Union Intellectual Property Office (EUIPO) gives you an exclusive right to use the trademark for a period of 10 years, renewable indefinitely. This exclusive right is granted to you on the Canadian territory, if registered in Canada, and for your sector of activity only. Your sector of activity corresponds, among other things, to the classes you selected during the availability search.
An exclusive right allows you to prevent your competitors from using your trademark, a similar trademark or a trademark that may be confusing with yours. In the same way, you must ensure that you do not infringe on the trademarks of others.
