Sometimes, a self-employed worker and a client decide to enter into a service agreement without drawing up a written contract. Not documenting the terms of a contractual agreement in writing, however, increases the risk of disagreement between the parties, and even of litigation in court if they cannot agree on their respective rights and obligations. That’s why it’s a good idea to draw up a written and signed contract beforehand, so that you can negotiate properly and define everyone’s expectations in advance, thereby limiting the hassle of a dispute with your co-contractor.
Like a contract for services, a self-employed contract is legally qualified as a contract for services, since the self-employed person also provides services to his or her customer. The difference with the service contract product we also offer is that the self-employed contract will be suitable for the provider who operates an unincorporated sole proprietorship, whereas the service contract will be more suitable for the provider who operates a corporation to offer his services.
*Please note that a service contract is different from an employment contract, in that a self-employed contract is not subject to the legal requirements for hiring an employee, since there is no subordination between an employee and an employer.
